The Role of the Responsible Person
Responsible Person (RP)
Transport for NSW requires each club to appoint a 'Responsible Person'. The role of an RP differs between
the two schemes. However, the RP or other nominated person within the club has the responsibility to
maintain a register of vehicles within the club, and hold records such as photographs and copies of current
documents for each vehicle.
The Historic Vehicle Scheme (HVS): When clubs requiring access to the Scheme register with Transport for
NSW (TfNSW) to become a 'Recognised Club', they are required to nominate a club officer to be the
'Responsible Person', who will become the point of contact for TfNSW.
The RP may be any member of the club, with NSWHMA recommending the Registrar, and it is this person
and only this person, who has the authority to sign and stamp completed 1259 Declaration forms. If the
club requires more than one person to be able sign forms, then the additional person/s must be notified to
TfNSW. Appointment of the additional persons and holders of club stamps should be recorded in the club's
minutes.
- The onus is upon clubs to notify Transport for NSW of any change to RP or other registered signatory.
- Service NSW, when processing HVS registrations, have the right and ability to verify the authority of
the signatory on the form against their records (rarely exercised).
For HVS, the RP has two options for certifying that a vehicle is in a safe working condition.
1. Use of Authorised Inspection Station (AIS) safety inspection report (pink slip). This is the method
recommended by NSWHMA and avoids any liability on the club and its officers. Pink Slips must be
hand written.
On the 1259 form, strike out the upper part of section 3 on the form, and enter the report
number and its date in the alternate section below.
2. Use of club inspection. Clubs are able to use this method after 2 years of operation.
- NSWHMA recommends that club inspectors should possess AIS accreditation or mechanical
certification.
- Inspections must be done to the same standard as at an Authorised Inspection Station.
- NSWHMA strongly recommends clubs take out insurance to indemnify club officials against
the liability they may be exposed to.
- The RP signing section 3 of the form is certifying that 'The vehicle is in a safe operating condition'
and in so doing takes full responsibility for the roadworthiness of the vehicle.

The Classic Vehicle Scheme (CVS):
Clubs on the 'List of Recognised Clubs' already utilising HVS are free to use CVS.
Clubs which are formed solely to use CVS are not required to register. However, such clubs are still
required to appoint a Responsible Person who holds the club stamp.
- The Declaration form 1835 is required to be prepared by the vehicle owner and submitted to the
RP to be stamped at the bottom of Section 3 only.
2. CVS requires a Blue Slip at establishment and Pink Slip at renewal (both must be hand written).
3. Club inspection (as for HVS) is not available in CVS.
